This Privacy Policy explains how Pominis LLC ("Pominis," "we," "our," or "us") collects, uses, discloses, and safeguards personal information when you access or use our websites, web‑based game‑creation platform, mobile or desktop applications, APIs, and related online services (collectively, the "Services"). By using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use the Services.

2. Information We Collect
  • Profile & Contact Data: Name, username, email address, mailing address, phone number, account credentials, company affiliation (Directly from you)

  • Payment & Billing Data: Limited payment card details, transaction history (processed via Stripe or similar PCI‑DSS–compliant provider) (Payment processor)

  • Prompts & User‑Generated Content: Text prompts, uploaded images, game scripts, feedback, comments (Directly from you)

  • Device & Usage Data: IP address, browser type, OS, referral URLs, clickstream data, in‑app events, crash logs (Automatic collection via cookies, pixels, SDKs)

  • Geolocation Data: Approximate location inferred from IP, device settings (Automatic collection)

  • Marketing & Communications: Preferences, survey responses, email interactions (Directly from you; email service provider)

  • Third‑Party Integrations: OAuth identifiers (e.g., Google, GitHub), platform IDs, external analytics (Chosen by you; integration partners)

We do not intentionally collect sensitive personal information (e.g., government IDs, health data, precise geolocation) or information from children under 13 except as described in Section 11.

3. How We Use Information

We process personal information only where we have a valid legal basis, such as:

  • Contractual necessity – to create and manage your account, provide the Services, enable payments, and respond to inquiries.

  • Service Providers & Sub‑Processors – cloud hosting (AWS), analytics (Google Analytics, PostHog), generative‑AI APIs (OpenAI, Anthropic, Google AI), email delivery (AWS), payment processing (Stripe), customer support (Intercom).

  • Business Partners & Integrations – when you choose to connect third‑party tools (e.g., Discord, GitHub, Steam) we disclose information as authorised by you.

  • Legal & Compliance – to courts, regulators, or law‑enforcement where required or to protect rights, property, or safety.

  • Corporate Transactions – in connection with mergers, acquisitions, or asset sales, subject to customary confidentiality.

We never sell or rent your personal information for monetary consideration.

5. Cookies and Tracking Technologies

We use cookies, SDKs, and similar technologies to: maintain session state and secure log‑ins (essential cookies); analyse site traffic and performance (analytics cookies); remember preferences and deliver personalised content (functional cookies); measure the effectiveness of our ads (advertising cookies – deployed only with consent where required). You can adjust browser settings to decline cookies or opt‑out of interest‑based advertising via optout.aboutads.info.

6. Data Storage and Security

Personal information may be processed and stored in the United States or any country where we or our service providers maintain facilities. We employ technical and organisational measures aligned with industry standards, including encryption in transit and at rest, least‑privilege access controls, regular penetration testing, and incident‑response procedures. No system is 100 % secure; you are responsible for safeguarding your account credentials.

7. Data Retention

We retain personal information only as long as necessary to fulfil the purposes stated in this Policy, comply with legal obligations, resolve disputes, and enforce agreements. When retention is no longer required, we will delete or anonymise the data.

8. Your Rights and Choices

Depending on your jurisdiction, you may have rights to:

  • Access – request a copy of the personal information we hold about you;

  • Rectify – correct inaccurate or incomplete data;

  • Delete – request erasure of your personal information;

  • Restrict / Object – limit or object to certain processing activities;

Submit requests via support@pominis.com. We will verify your identity before responding and may deny requests where permitted by law. California residents may exercise CCPA rights using this same process. EU/UK/Swiss residents may lodge complaints with their local supervisory authority.

9. International Data Transfers

We rely on standard contractual clauses and equivalent safeguards for transfers of personal information from the European Economic Area, United Kingdom, or Switzerland to the United States or other third‑country locations.

10. Generative‑AI Providers

When you submit Prompts or upload content, we transmit that data—along with minimal metadata—to third‑party generative‑AI APIs solely to produce the requested output. We instruct these providers not to use your Prompts or AI Output to train their models unless you have separately opted‑in.

11. Children's Privacy

The Services are not directed to children under 13 (or the minimum age under local law) except through a school or educator acting as the parent's agent and having obtained verifiable parental consent consistent with COPPA and FERPA. If we learn that we have collected personal information directly from a child, we will delete it promptly.

12. Changes to This Policy

We may update this Privacy Policy periodically. When we do, we will revise the "Last Revised" date and, for material changes, provide advance notice via email or in‑product banner. Continued use of the Services after the effective date constitutes acceptance of the revised Policy.
